PCKL DROP LLC – Tournament Team & Ambassador Agreement

Company: PCKL DROP LLC (“PCKL DROP,” “Company,” “we,” “us”)
Participant: The individual submitting this form (“Participant,” “you”)
1. Purpose
This Agreement governs your application and potential participation in the PCKL DROP Tournament Team and/or PCKL DROP Ambassador Program. By submitting this form, you acknowledge and agree to the terms below.
2. Term
This Agreement begins on the date you submit this form (the “Effective Date”) and continues for one (1) year, unless terminated earlier under this Agreement. PCKL DROP may renew, extend, or modify participation terms at its discretion.
3. Tournament Team Selection (No Guarantee)
Submission of this Agreement does not guarantee placement on the PCKL DROP Tournament Team. Roster decisions are made at the sole discretion of PCKL DROP based on skill level, competitive experience, availability, team needs, and overall fit.
4. Ambassador Program Consideration
All Tournament Team applicants are automatically considered for the PCKL DROP Ambassador Program. If you are not selected for the Tournament Team, you may still be offered participation in the Ambassador Program at the sole discretion of PCKL DROP.
5. Participant Responsibilities (Team + Ambassador)
- Represent PCKL DROP in a professional, respectful, and sportsmanlike manner on and off the court
- Follow reasonable brand, conduct, and promotional guidelines provided by PCKL DROP
- Avoid misleading statements or exaggerated claims about PCKL DROP products
- Refrain from conduct that could harm the reputation or goodwill of PCKL DROP
- When required for events, wear approved PCKL DROP gear and present a clean, professional appearance
6. FTC Disclosure & Advertising Compliance (Required for Promotions)
If you create promotional, marketing, or social content referencing PCKL DROP, you must comply with applicable advertising laws and FTC endorsement guidelines. You must clearly disclose your relationship with PCKL DROP in each promotional post.
Acceptable disclosures include:
- #ad
- #sponsored
- #pckldropambassador
- “Proud ambassador for PCKL DROP”
- “Partnered with PCKL DROP”
Use of #pckldrop alone is NOT sufficient disclosure.
7. Compliance Monitoring & Enforcement
PCKL DROP may monitor Participant content for compliance. If you fail to meet disclosure or conduct requirements, PCKL DROP may request corrections, suspend benefits, revoke codes, remove you from the program(s), and/or terminate this Agreement.
8. Discount Codes, Links & Program Use (If Issued)
If you receive a personal discount code and/or referral link:
- You may use and share it only as permitted by PCKL DROP
- You may not engage in self-dealing, resale, bulk distribution, fraud, or other misuse
- PCKL DROP may change, suspend, or revoke codes/links at any time
9. Compensation, Support & Benefits
Participant may receive benefits such as commissions, discounts, gear, tournament entry assistance, travel support (for select events), bonuses, or other incentives. All benefits are optional and not guaranteed, and may be changed or discontinued at any time at the sole discretion of PCKL DROP.
10. Exclusivity / Brand Conflicts
During the term, Participant agrees not to publicly promote or represent competing pickleball apparel or gear brands in a manner that conflicts with participation in PCKL DROP programs, unless PCKL DROP provides prior written permission.
11. Use of Name, Image, Likeness, Voice & Media
Participant grants PCKL DROP LLC an irrevocable, perpetual, worldwide, royalty-free right and license to use, reproduce, edit, publish, display, distribute, and create derivative works from Participant’s name, image, likeness, voice, audio recordings, photographs, video recordings, social media content, and any content created in connection with PCKL DROP for marketing, advertising, promotional, and commercial purposes in any media now known or later developed, including but not limited to social media, websites, advertisements, email marketing, and digital or print campaigns.
This permission applies to content created during the term and may continue after termination for previously created materials. Participant waives any right to inspect or approve final content and releases PCKL DROP LLC from any claims arising from the lawful use of such media.
12. Independent Contractor / Non-Employee Status
Participation in the Tournament Team and/or Ambassador Program is not employment. Participant is not an employee, partner, agent, or joint venturer of PCKL DROP. Participant is responsible for personal taxes, expenses, and insurance, and for travel arrangements unless otherwise provided in writing by PCKL DROP.
13. Confidentiality
Participant agrees not to disclose confidential or non-public information about PCKL DROP, including upcoming product releases, pricing strategies, vendor relationships, internal operations, or marketing plans, unless authorized in writing by PCKL DROP.
14. Termination
PCKL DROP LLC reserves the right to approve, deny, suspend, or terminate Participant’s participation in the Tournament Team and/or Ambassador Program at any time, with or without cause, at its sole discretion. Upon termination, Participant must stop representing themselves as a PCKL DROP team member/ambassador and stop using any associated benefits (including codes/links).
15. Limitation of Liability
To the fullest extent permitted by law, PCKL DROP LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from participation in the program(s).
16. Governing Law; Maryland Jurisdiction
This Agreement is governed by the laws of the State of Maryland. Any dispute arising out of or relating to this Agreement must be brought in the state courts located in Maryland. The Parties consent to personal jurisdiction in Maryland and waive objections to venue or forum non conveniens.
17. Program Guidelines & Updates
Participant agrees to comply with all current PCKL DROP Tournament Team and Ambassador Program guidelines, policies, and requirements, including any program guides provided by PCKL DROP, which may be updated from time to time. Continued participation after updates constitutes acceptance of the revised guidelines.
18. Entire Agreement
This Agreement constitutes the entire understanding between the Parties regarding Participant’s application and participation in the Tournament Team and/or Ambassador Program and supersedes any prior discussions or understandings related to the subject matter.
19. Electronic Signature & Acceptance
By checking the agreement box and submitting this form, you acknowledge that you have read and agree to this Agreement and consent to a legally binding electronic signature under applicable law, including the U.S. E-SIGN Act and Maryland law.
