PCKL DROP LLC – Brand Ambassador Agreement

Company: PCKL DROP LLC (“PCKL DROP,” “Company,” “we,” “us”)
Ambassador: The individual submitting this application (“Ambassador,” “you”)
1. Purpose
This Agreement sets forth the terms under which you may participate in the PCKL DROP Brand Ambassador Program. If accepted, you agree to represent and promote PCKL DROP in a positive and professional manner.
2. Term
This Agreement begins on the date you submit this form (the “Effective Date”) and continues for one (1) year, unless terminated earlier in accordance with this Agreement. PCKL DROP may renew or extend the Agreement at its discretion.
3. Ambassador Responsibilities
- Promote PCKL DROP products in good faith
- Represent the brand professionally, respectfully, and honestly
- Follow all brand guidelines provided by PCKL DROP
- Avoid misleading, false, or exaggerated claims
- Refrain from conduct that could harm the reputation of PCKL DROP
4. FTC Disclosure & Advertising Compliance
Ambassador agrees to comply with all applicable advertising and endorsement laws, including FTC Endorsement Guides.
Ambassador must clearly disclose their relationship with PCKL DROP in any promotional content.
Acceptable disclosures include:
- #ad
- #sponsored
- #pckldropambassador
- “Proud ambassador for PCKL DROP”
- “Partnered with PCKL DROP”
Use of #pckldrop alone is NOT sufficient disclosure.
5. Compliance Monitoring & Enforcement
PCKL DROP may monitor ambassador content. Failure to disclose properly may result in warnings, suspension, or termination.
6. Discount Codes & Program Use
- Codes may not be abused, resold, or misused
- No self-dealing unless permitted
- PCKL DROP may modify or deactivate codes at any time
7. Compensation & Benefits
Benefits may include commissions, gear, discounts, or promotions. No wages are guaranteed.
8. Exclusivity
Ambassador agrees not to promote competing pickleball apparel brands without written permission.
9. Use of Likeness
PCKL DROP may use Ambassador’s name, image, and content for marketing purposes.
10. Independent Contractor
Ambassador is not an employee and is responsible for their own taxes and expenses.
11. Confidentiality
Ambassador agrees not to share confidential company information.
12. Termination
PCKL DROP LLC reserves the right to approve, deny, suspend, or terminate any Ambassador at any time.
13. Limitation of Liability
PCKL DROP shall not be liable for indirect or consequential damages.
14. Governing Law & Jurisdiction
This Agreement shall be governed by the laws of the State of Maryland. All disputes shall be handled in Maryland courts.
15. Ambassador Program Guidelines & Policies
Ambassador agrees to comply with all PCKL DROP Ambassador Program guidelines, policies, and requirements, including the PCKL DROP Ambassador Program Guide, which may be updated from time to time.
These guidelines may include commission structures, discount code rules, posting expectations, rewards, incentives, and brand content requirements.
Ambassador acknowledges that these program guidelines are incorporated into this Agreement and may be modified at the sole discretion of PCKL DROP LLC.
Continued participation after updates constitutes acceptance of the revised guidelines.
16. Entire Agreement
This Agreement constitutes the entire agreement between the parties.
17. Electronic Signature & Acceptance
By submitting this form, you agree to this Agreement and consent to a legally binding electronic signature under the U.S. E-SIGN Act and Maryland law.
